It seems that the health of Tom Girardi is declining as he faces more legal woes.
In the 81-year-old Tom’s involuntary bankruptcy case brought by creditors, Girardi’s brother, Robert Girardi, filed a declaration claiming that he suffers from short-term memory loss and needs conservation, according to legal documents obtained by The Blast.
Robert had also once claimed in the filing that the estranged husband of “The Real Housewives of Beverly Hills” star Erika Jayne is “not capable of making rational decisions with respect” to his financial responsibilities and is “incapable of realizing” the consequences of the bankruptcy filings.
Robert says he’s trying to become a conservator for his brother and will help the bankruptcy court gain access to the records of Tom. “He also claims that Tom is unable to have a “reasonable conversation” about his various legal problems.
The documents claim, “My brother has short-term memory loss, often asking those around him the same questions over and over,”
On Robert’s motion, the judge has yet to rule.
Also as per the reports, Robert Keese, Tom’s law firm partner, sued to dissolve their business venture, known as 1126 Wilshire Partnership. Keese, joined by Robert Finnerty and Jill O’Callahan, claims that Tom never paid them the partnership’s approximately $315,000 in revenue, claiming he took the money “for his own personal profit.”
The three plaintiffs also claim in the documents that, without their knowledge, Tom took out loans against the property valued at up to $7.46 million. As a result, the plaintiffs allege that they have sustained a loss of around $442,500 each in equity.
Additionally, Tom is in the midst of a class-action lawsuit in the Lion Air settlement over missing funds. Wells Fargo Financial is also suing him for allegedly breaching a written agreement and conversation with the bank.
